Subject: URGENT Request for Oversight: Continued Use of Emergency Powers Under HRS 127A

Dear Members of the Hawaiʻi State Legislature,

I am writing with concern about the Governor’s continued use of emergency powers under Hawaii Revised Statutes Chapter 127A—most recently for the Manjano anemone in Kāneʻohe Bay.

This appears to be a natural resource issue, typically handled by the Department of Land and Natural Resources—not a true emergency involving immediate danger to people or property.

At the same time, there are multiple emergency proclamations still active in Hawaiʻi, many of which have been extended repeatedly. These proclamations allow for the suspension of state laws, including procurement requirements under Hawaii Revised Statutes Chapter 103D.

Emergency powers are meant to be temporary and limited. When the Governor continues to use them repeatedly and without clear endpoints, it places decisions that belong with the Legislature into the Governor’s hands, altering the normal balance of governmental authority.
 

I respectfully ask the Legislature to investigate the Governor’s continued use of emergency powers under Chapter 127A and ensure proper balance between the branches of government.

Since July 2023, Hawaii Governor Green has signed 9 Emergency Proclamations over 100 times and suspended at least 32 laws, all without legislation, or public input.
